R.T.E. As per Act-2009, Gujarat RTE Rules-2012 is in force in the entire state. The following changes have been made in Rule No. 03 (1) of Gujarat RTE Rules-2012 by the notification of the education department referred to.

Chapter-2: Right to Free and Compulsory Education 3. (1) On June 1 of the academic year a child who has not completed the sixth year Such a child will not normally be admitted to elementary school.
During the academic years 2020-21, 2021-22 and 2022-23, any child who has completed 5 years of age on June 1 of that academic year will be eligible for admission in that year.

The notification of the Department of Education regarding the said amendment has been sent by the letter showing reference-2. The wise report from your level to all the primary schools under your jurisdiction.


Rules and Orders (Other than those published in Parts I, I-A, and I-L) made by the Government of Gujarat under the Central Acts

The matter does not appear to have been properly publicized at the district level. Therefore, it is reiterated that all the above mentioned primary schools will have to be notified immediately. Parents should also be advised that, if a parent wants to provide pre-primary education to their child, the schools in which the child is enrolled in pre-primary (Playgroup, Nursery, Jr.KG, Sr.KG) Admission should be given when the child completes pre-primary education and completes the process of getting admission in Std-1 by the age of 6 years on June 1 in the academic year 2023-24.

Right of Children to Free and Compulsory Education Act, 2009.
No: GH/SH/04/PRE/122019/Single File-21/K:- In exercise of the powers conferred by sub-section (1) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), the Goverment of Gujarat hereby makes the following rules further to amend the Right of Children to Free and Compulsory Education Rules, 2012, namely;

1. (1) These rules may be called the Right of Children to Free and Compulsory Education (Amendment) Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Right of Children to Free and Compulsory Education Rules, 2012, in rule 3, for sub rule(!), the following sub-rule shall be substituted, namely:

"(1) Admission of pupils : No Elementary School shall admit a child in 1" standard who has not completed 6th year of age on the 1" June of the academic year: Provided that for the academic years 2020-2021, 2021-2022 and 2022-2023 a child shall be eligible for admission who has completed 5th year of age on the 1 June of the respective academic year."
